Terms of Service

Welcome to Fairway Ladies Golf ("Fairway Ladies," "we," "us," or "our"). By creating an account or using the app, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the app.

1. Who can use the app

You must be at least 13 years old (or the minimum age required to consent to data processing in your country) and lawfully able to enter into a binding agreement. If you are signing up on behalf of a league or club, you confirm you have authority to do so. We may suspend or remove access for anyone who violates these Terms.

2. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information at sign-up and to keep it current. We may use your email address to send account and league-related notices. You can close your account at any time; closing it does not automatically remove content you contributed to a shared league space.

3. Leagues, clubs, and leadership roles

A league leader ("leader") creates a league, sets its name, colors, and logo, and invites members. Leaders have additional tools - approving sign-ups, managing photos, and welcoming members - and are responsible for using those tools in line with these Terms and their league's own rules. A leader may assign roles (such as board members) within their league. We are not a party to how any individual league governs itself and do not adjudicate internal league disputes.

4. Acceptable use

You agree not to:

• misrepresent your identity, handicap, or scores;
• harass, bully, or discriminate against any member;
• post or upload content that is unlawful, infringing, or sexually explicit;
• use the app to spam, scrape, or overload our systems;
• attempt to access another member's private development plan, scores, or data; or
• misuse the photo or tagging features to post images of people without their consent.

5. Content and photos

You retain ownership of content you submit (posts, scores, photos). When you contribute content to a league space, you grant us a non-exclusive, royalty-free, worldwide license to host, display, and process that content solely to operate the features it was shared with - for example, showing a photo in your league's album. Photos use opt-in tagging and pass through a leadership approval queue before they appear publicly. You may request removal of your content at any time.

Walk-up songs, music, and videos

A walk-up song in Fairway Ladies is the name of a song and links that open it in a third-party music service (Apple Music, Spotify, or YouTube). We do not host, stream, sell, or license music, and you may not upload music or other sound recordings to the app. Listening to a song happens inside that service and is subject to its terms.

Walk-up videos are posted without sound: the app removes the audio on your device before a video is uploaded. Only share a video you have the right to share, and only of people who are happy to be in it. If you link to a video on another platform, that platform's terms apply.

Copyright complaints

We respect the rights of songwriters, artists, photographers, and other creators. If you believe something in the app infringes your copyright, email barb@mykeyplans.com with (1) your name and contact details, (2) the work you believe was copied, (3) where it appears in the app, and (4) a statement that you are the owner or are authorized to act for the owner. We will review it promptly and remove content where appropriate. Members can also report any post, song, video, or comment from inside the app, and league leaders can remove it. We may remove content or close the accounts of people who repeatedly infringe.

6. Scores and the scorecard scanner

You may enter scores manually or by photographing a scorecard. When you use the photo scan, our system reads the card and suggests scores; you are responsible for confirming the suggested scores before they are saved. Scores shown in the app are for your league's own enjoyment and net leaderboards. Fairway Ladies does not post to or retrieve official handicaps and makes no guarantee that any score recorded here is accepted by a handicapping authority.

7. Individualized Golf Plans and Smart features

Features such as "My Golf Vision," "My Plan," and the scorecard scanner are powered by smart tools. These tools can make mistakes. Plans and suggestions are general guidance to support your development - not professional instruction, medical advice, or a guarantee of results. Always use your own judgment and consult a qualified coach or professional for personalized instruction.

8. Privacy

Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Fees

Core league features may be free or paid depending on your plan. Any fees are disclosed before you are charged. Paid plans are purchased on our website (fairwayladiesgolf.com) through our payment processor, Stripe, and renew automatically at the end of each monthly or yearly period until canceled. When a plan includes a free trial, you will not be charged until the trial ends, and you can cancel before then at no cost; a trial is offered once per person (Solo Pro) or once per league (League plan). You can cancel at any time from Your plan → “Manage or cancel my plan”; your access continues until the end of the period you already paid for. Payments already made are not refunded except where required by law.

10. Third-party services

The app uses third-party services such as Google for sign-in, and links out to music and video services such as Apple Music, Spotify, YouTube, Instagram, TikTok, and Facebook. Your use of those services is also subject to their own terms and policies. We are not responsible for the practices of third-party providers.

11. Disclaimer of warranties

The app is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant the app will be uninterrupted, error-free, or that scores, plans, or smart suggestions will be accurate.

12. Limitation of liability

To the maximum extent permitted by law, Fairway Ladies and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits or data, arising out of or related to your use of the app - even if advised of the possibility of such damages.

13. Termination

You may stop using the app at any time. We may suspend or terminate your access if you violate these Terms or to protect the service or other members. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will remain in effect.

14. Changes to these Terms

We may update these Terms from time to time. We will post the revised version here with a new "Last updated" date. Material changes will be communicated through the app or by email. Continued use after changes take effect means you accept the updated Terms.
